雇员退休金计划是政府在1995年推出的。自推出以来，该计划经历了多次修订，并被无数诉讼所困扰。一场这样的斗争持续了20多年，最终于11月4日由最高法院宣判。在最高法院的判决之后，政府很快在12月29日发出了一份通告，概述了符合条件的员工应该做什么。
在深入了解通知的细节之前，让我们先了解不满的根源。
雇员公积金(EPF)，俗称退休基金，是一项计划，雇员和雇主每月按基本工资的12%和生活费津贴的比例供款。
作为公积金计划的成员，雇员有权在退休时领取一笔总金额的退休金(公积金)，在58岁后领取退休金(养老基金)，以及在工作期间死亡时领取保险金。
根据公积金计划，雇员供款的12%必须存入公积金。然而，雇主贡献的8.33%进入养老基金，但上限为1250卢比。这里需要注意的是，2014年之前加入公积金的个人可以选择将雇主供款总额的8.33%分配给养老基金，通过行使通常所说的“双重选择权”，没有任何上限。提高对养恤基金的缴款在财务上对雇员更有利。然而，双重选择的应用是许多争论的开始。首先，大多数员工从未意识到这个选项的存在。第二，在提出这方面的申请时，当局以某种借口拒绝了申请。
在2016年10月4日对R.C. Gupta等人的判决中，最高法院的一个分庭驳回了公积金当局的论点，即上述条款考虑在特定时间内行使期权。根据这一判决，政府发布了一份新的通知，为迄今为止双重申请选项被拒绝的员工提供了重新申请的机会，使他们有权领取养老金，不受上限限制。
有资格通过数字方式申请验证其选择的人包括:养老金领取者，作为雇员，在EPF计划下的工资超过了5000或6500卢比的普遍工资上限;在公积金计划下行使双重/联合选择权的人士;申请被有关部门拒绝的。
政府通过这一通告，旨在减轻领取养老金者的困境。它力求确保那些在其就业期间拨出这种较高数额养恤金的人获得较高的养恤金。该等退休人员可于www.epfindia.gov.in以订明表格递交申请。
若部分份额需由公积金调整为养老基金及重新存入基金，则验证申请表须附有免责声明。申请必须载有下列指明文件，以作证明及作进一步处理之用:经雇主核证的公积金计划双重/联合选择权证明;以及在超过5000或6500卢比的普遍工资上限的更高工资的公积金汇款证明;以及在超过普遍工资上限的较高工资时向养老基金汇款的证明;以及公积金助理专员或职工公积金组织的其他上级机关对该要求/汇款的书面拒绝。
值得注意的是，最高法院在11月4日的裁决中还为2014年9月1日之前注册但尚未退休的成员提供了额外的四个月时间，以要求双重选择并利用更高的养老金。虽然该通知对这些申请只字未提，但有关部门很可能会发布另一份通知来提供指示。
